RM of Wallace-Woodworth council decides on a variance and other business - Virden Empire-Advance

Sept. 13, the RM of Wallace-Woodworth met for their Regular Council Meeting at 08:10 a.m.

Present in Office: Reeve Clayton Canart; Councillors: Barb Stambuski, Diana MacDonald, Val Caldwell, and Rea Kinnaird; CAO, Garth Mitchell; and ACAO, Iris Vercaigne.

Others attended in the office: Kirk Gilliard (Property Owner, arrived at 9:02 a.m.); Christa Milne (Arts Mosaic); and Cory Nixon (Building Inspector/Dev't Officer).

Absent: Councillors Mark Humphries and Denis Lachapelle.

The agenda was approved and minutes from Aug. 23 were approved.

The first matter of business was a resolution authorizing the purchase and installation of "STOP" signs on Road 142W (at the Road 69N intersection), as per the recommendation of the Transportation Committee. Carried

Quotes for Snowblade and Pallett Fork: Council reviewed the recommendations from Public Works Superintendent, Greg Alberts and the quotes received from Hitrac and Virden Ag for loader snowblade and pallett fork attachments.

Loader Snowblade - Council approves the purchase of a Loader AMI Reactor Snowblade, Model 521016 with electrical harness kit from HItrac in the amount of $23,900 (excluding taxes and installation of wiring kit, includes delivery from Winnipeg). Carried

Loader Pallett Fork Purchase - Council approves the purchase of an HLA Pallett Fork for Loader, HD 7560 from Virden Ag and Parts in the amount of $4,170.00 (excluding taxes, installation, and shipping). Carried

2022 Road Gravelling (Ward 1): Cochrane Stock Farms - Council of the R.M. of Wallace-Woodworth approves Invoice No. 22104 in the amount of $33,693.04 (excluding GST) for payment to Cochrane Stock Farms for the supply of 3,963.88 yards of 3/4" Crushed traffic gravel to complete the 2022 Road Graveling Program in Ward 1.   Carried

Gate Camera Costs - Council approves the estimate from 3CTech Ltd. for the supply and installation of one solar camera and SIM card data package at the Elkhorn Lagoon gate in the amount of $890 (excluding taxes), as per the recommendation of the Utility Committee. Carried

Disaster Prevention and Climate Resiliency Program Final Report - Council approves the Final Reports for submission to the Province as part of the requirement under the Disaster Prevention and Climate Resiliency Program - Elkhorn Lagoon Expansion, Forcemain, and Lift Station Project, as per the recommendation of the Utility Committee. Carried

Elkhorn Lagoon: Russell Redi-Mix Letter of Understanding - Council accepts the Letter of Understanding received from Russell Redi-Mix Concrete (RRMC)/Green Infrastructure Partners for the Elkhorn Lagoon Expansion, Forcemain, and Lift Station outlining the deficiencies on the project that will need to be rectified by RRMC over and above any warranty issues that may arise during the one-year warranty period.  Carried

Council approves Progress Payment No. 11 from Russell Redi-Mix Concrete in the amount of $31,000 (including applicable taxes) as Full Project Payment for the Elkhorn Lagoon Expansion, Forcemain, and Lift Station; as per the recommendation of JR Cousin Consultants Ltd. Carried

EDAM - Reeve, Clayton Canart or alternate be approved to attend the Economic Developers Association of Manitoba Awards Night Gala being held in Winnipeg, Manitoba on Sept.22 approving out of pocket expenses be authorized. Carried

Kirkella Pasture Committee Request - Council supports the KIrkella Pasture Committee's upcoming Archie and Pipestone 4-H Beef Clubs tour on Oct. 2, with a donation of $250 from the Special Events/Project Funding 2022 allocation. Carried

Oak Lake High School Rodeo Sponsorship Request- Council supports the Annual Rodeo scheduled on Sept. 17 and 18, 2022 organized by the Oak Lake High School Rodeo Association with a donation of $350 from the Special Events/Project Funding 2022 allocation. Carried

Virden Theatre Production Matilda Sponsorship Request - Council of the R.M. of Wallace-Woodworth supports Matilda: The Musical scheduled on Nov.9 - 13, 2022 organized by Virden Theatre Productions with a donation of $250 from the Special Events/Project Funding 2022 allocation. Carried

R.M.'s Annual Holiday Banquet - Council discussed the Annual Holiday Banquet that was postponed for two years due to the pandemic. Administration will look into venue options in Virden.

Manitoba Tourism Conference - Mark Humphries be approved to attend the Manitoba Tourism Conference being held in Winnipeg, Sept. 12 – 13 with per diem expenses authorized. Carried

Coun. Kinnaird reported on the West-Man Nursing Home and the Virden & Area Doctor Recruitment and Retention Committee meeting.

Coun. Stambuski and Coun. Caldwell reported on the Westman Emergency Group meeting.

Coun. MacDonald reported on the Virden & Area Doctor Recruitment and Retention Committee; and Joint Council meeting with the Town of Virden.

Reeve Canart reported on the Joint Council meeting with the Town of Virden and the Public Hearing on the Federal Electoral Boundaries Commission for Manitoba.

Reeve Canart chaired the public hearing. ACAO, Iris Vercaigne presented Variation Order No. 02/2022 information. Building Inspector/Development Officer, Cory Nixon presented the background information; notice of variation; correspondence received from John and Kim Shepherd; and recommendation. Kirk Gilliard, property owner shared information on his plans for a second grain bin and discussed options for snow protection. No further objections were raised.

Hearing no further objections, Reeve Canart ended the public hearing for Variation Order No. 02/2022.

Public Hearing closed at 9:16 and Regular Meeting of Council reconvene by resolutions. Carried

Variation Order No. VO-02-2022 (Crude Operating Ltd.) Resolution No: 22/268

WHEREAS Crude Operating Ltd., the applicant and the landowner of the property SE 3-11-29WPM, and located in the R.M. of Wallace-Woodworth, Roll No.99000.000, has applied to the Council of the R.M. of Wallace-Woodworth to vary the application of the R.M. of Wallace-Woodworth Zoning By-Law No. 03/2019 as amended, under Part 1 subsection 17, in order to vary the established requirements in accordance with the following description:

- To reduce the minimum property line setback requirements for an accessory structure within an “RG” Rural General Zone as follows: From: 125 feet To: 65 feet

Council of the R.M. of Wallace-Woodworth after careful consideration of the Application and any representations made for or against, approved the Variation Order Application #VO-02-2022 subject to the following conditions:

1. That the applicant provide snow guarding protections to prevent snow from drifting across the road allowance 2. That the snow guard supplied be in place every winter season that the grain bin is on location 3. That the applicant enter into a development agreement to ensure snow protection is in place for Road 60N 4. That this Order be acted upon within 12 months of the date of making. Resolution Carried

Information Council reviewed the August 22, 2022 TCWPD Meeting Minutes.

Christa Milne from the Virden Arts Mosaic joined as a delegation at 9:30 a.m. to present an update on various activities mentioned on their Annual Report. Information shared included: impact of the pandemic; bridge funding used as community fund; recent art installations ie. Elkhorn Library; and workshops offered in partnership with local businesses. The goal is to make art more accessible and to offer arts programming. An invitation to join the Committee was extended to Council.  

By resolution Council entered into an "In Camera" Session at 9:44 a.m. to discuss Legal, Labour, Land. The In-Camera session adjourned at 10:24 a.m.
